3rd Quarter Meeting Minutes
September 20, 2005

The Surety Association of Ohio held its fall quarterly meeting at the Embassy Suites Hotel on September 20, 2005. Prior to the board meeting, members and the board were treated to lunch, followed by a presentation from David Leneghan, Esq.

Mr. Leneghan explained the background of the landmark case of Cementech, Inc., vs. City of Fairlawn, and it’s implications to the construction and surety industries, and the next steps between the City of Fairlawn and Cementech, Inc., and the case possibly being heard by the Ohio Supreme Court. SAO President Marc Oravecz presented David a small gift as a token of our appreciation afterwards and thanked the members for their attendance.

Subsequent to the luncheon presentation, the following board and committee members held their 3 rd quarter meeting: Marc Oravecz, Jack Kehl, Bill Wildenheim, George Siegler, Frank Sullivan, Gayle McClellan and Chuck Teeter.

Marc opened the meeting with the announcement that he is stepping down as President after seven years on the board in one capacity or another effective January 1, 2006. In addition, Marc announced that Eric Schmidt (not in attendance) would also be stepping down. Chuck Teter also announced that he was looking to step down, but would help continue with the ODOD issue (Ohio Department of Development) until it is resolved.

Several discussions followed these announcements. It was agreed that Jack Kehl will be nominated for the position of president at the next member meeting, Bill Wildenheim is going to remain treasurer and George Siegler shall maintain the Secretary position. Discussions continued as to ideas to fill the vice president position, but no decisions were made. With respect to the other committee positions, Frank Sullivan is willing to consider another committee role, but was not keen on the VP position. Marc offered to help maintain the website. Gayle offered to retain the membership chair role or was willing to switch with Jackie Christensen as her role as social chairperson.

Jack was going to check on some potential ideas to fill the VP, Education and Legislative roles, and check with Jackie Christensen to get her thoughts and to verify she is willing to continue in her role or would be willing to switch with Gayle.

The next issue was related to the upcoming holiday gathering. It was agreed we would again have it at the Hilton at Easton Town Center in Columbus . Chuck Teter will run the 50/50 to help fund the Surety Scholarship. It was also decided that the committee will spend up to $1,000 on 3-4 door prizes.

The SAO scholarship was not awarded to any applicants in 2004. The board agreed to announce at the holiday gathering that it will broaden the scholarship to any college bound or currently enrolled college student who is a dependent of an employee of a member company. The student will continue to need to be a business major.

Other topics discussed:

    • ODOD – no updates or changes per Chuck
    • YMCA – Combination of public and private funding, but waived bond, breaking procurement laws. Marc sent a letter addressing our concern with respect to the waiver of the final bonds.
    • Bill Wildenheim presented the SAO the 8-31-05 Balance Sheet and Profit and Loss statement.

The meeting was then adjourned at approximately 2:30. The next meeting will be at the Holiday party in December.
